This privacy notice (“Notice”) explains how Zipstack Inc. d/b/a Visitran or any of its affiliates or subsidiaries. (“We”, “Us”, “Our”, “Zipstack”, “Visitran”) processes Personal Data collected from natural persons as specified in the section “How We Collect, Use and Share Your Personal Data” (“You”).
1. DEFINITIONS
Terms not specifically defined herein shall have the meaning ascribed thereto in the Terms.
1.1 “Controller” means the natural or legal person, public authority, agency, or other body which alone or jointly with others determines the purposes and means of the processing of Personal Data.
1.2 “End-User” means any person or entity with whom the User interacts using the Service(s).
1.3 “Personal Data” means any information relating to an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.
1.4 “Processor” means a natural or legal person, public authority, agency, or other body which processes Personal Data on behalf of the Controller.
1.5 “Service(s)” shall have the meaning ascribed to it in the Terms.
1.6 “Subscriber” means the natural or legal person that has subscribed to the Service(s) by agreeing to the Terms or signing any other agreement for the subscription and use of the Service(s).
1.7 “Terms” means the Terms of Service at Terms of Service.
1.8 “Website(s)” means the websites owned and operated by Us including visitran.com and zipstack.com.
2. HOW WE COLLECT, USE AND SHARE YOUR PERSONAL DATA

2.3 If You provide Us with any Personal Data relating to other individuals, You represent that You have the authority to do so and, where required, have obtained the necessary consent, and acknowledge that it may be used in accordance with this Notice.
2.4 In addition to the details provided above, We may also share Your Personal Data with:
a) Our group entities (including companies We may acquire in the future) to provide and improve Our Services.
b) Third Parties involved in a Corporate Transaction: If We become involved in a merger, acquisition, or any sale of assets, We will, in accordance with applicable laws, use reasonable efforts to notify You of any transfer of Personal Data to an unaffiliated third party.
c) Law enforcement authorities, government authorities, courts, dispute-resolution bodies, regulators, auditors, and any party appointed or requested by applicable regulators to carry out investigations or audits of Our activities.
d) Professional advisors who assist Us in enforcing Our contracts and policies, handling claims, managing Our company effectively, and in relation to disputes.
3. THIRD-PARTY SERVICE PROVIDERS
We may employ third-party companies and individuals to facilitate Our Service(s) (“Service Providers”), provide Service(s) on Our behalf, perform Service-related tasks, or assist in analyzing how Our Service(s) are used. These Service Providers have access to Your Personal Data only to perform these tasks on Our behalf and are obligated not to disclose or use it for any other purpose.
Google Workspace API Data Usage
We utilize Google Workspace APIs to provide core functionalities within Our Service(s). We do not use Google Workspace user data to develop, improve, or train generalized AI/ML models. All user data obtained through Google Workspace APIs is used solely to provide Service(s) functionalities (e.g., Single Sign-On).
PostHog
We use PostHog for collection and analysis of visitor statistics. This information is stored by PostHog and used to understand Website(s)/Service(s) usage with the intention of improving the Service(s). See PostHog’s privacy policy at https://posthog.com/privacy.
4. LEGAL BASIS FOR PROCESSING (EEA REGION)
4.1 If You are a data subject from the European Economic Area (EEA), Our legal basis for collecting and using the Personal Data described above will depend on the Personal Data concerned and the specific context in which We collect it.
4.2 We will normally collect Personal Data from You only where We need it to perform a contract with You, where processing is in Our legitimate interests and not overridden by Your data-protection interests or fundamental rights and freedoms, or where We have Your consent. In some cases, We may also have a legal obligation to collect Personal Data from You. If We process Personal Data in reliance on Your consent, You may withdraw Your consent at any time.
4.3 If You have questions or need further information concerning the legal basis on which We collect and use Your Personal Data, please contact Us using the contact details in Section 13.
5. INTERNATIONAL TRANSFER
5.1 We mainly process Personal Data in the United States. However, We may transfer Personal Data outside the United States for the purposes referred to in this Notice. We will ensure that the recipient of Your Personal Data offers an adequate level of protection comparable to that provided under applicable data-protection laws.
5.2 If You are a resident of the EEA, when Your Personal Data is processed outside the EEA, We will ensure that the recipient offers an adequate level of protection (e.g., Standard Contractual Clauses under Article 46 GDPR) or we will obtain Your prior consent.
6. RETENTION OF PERSONAL DATA
6.1 We retain Personal Data where there is an ongoing legitimate business need to do so.
6.2 Where no such need exists, We will delete or aggregate the data; if deletion is not possible immediately, We will securely store and isolate the data from further processing until deletion is possible.
7. SECURITY OF PERSONAL DATA
We use appropriate technical and organizational measures to protect Personal Data that We collect and process. The measures We use are designed to provide a level of security appropriate to the risk. 8. YOUR RIGHTS
You are entitled to the following rights:
8.1 Request access and correction of Your Personal Data.
8.2 If processing is based on consent, withdraw consent at any time (without affecting prior lawful processing).
8.3 Complain to a data protection authority about Our collection and use of Your Personal Data.
8.4 Opt-out of marketing communications at any time (use the “unsubscribe” link in emails or contact Us).
If You are a resident of the EEA, UK, or Switzerland, You may also:
a) Request deletion/erasure,
b) Object to processing or ask Us to restrict processing,
c) Request portability of Your Personal Data.
To exercise Your rights, please contact Us using the details in Section 13. We verify requests before acting and respond within a reasonable timeframe per applicable law.
9. COOKIE POLICY
9.1 We use cookies to collect standard internet log information and visitor behavior information. We also set cookies to collect information (often aggregated and non-identifying) to help Us understand site usage, measure marketing effectiveness, customize the Website(s), or make advertising more relevant.
9.2 Essential Cookies: enable core functionality (security, network management, accessibility). You may disable them via your browser, but the Website(s) may not function properly.
9.3 Analytics/Customization/Advertising Cookies: help Us improve Our Website(s) by collecting and reporting how You use it (in a way that does not directly identify anyone).
9.4 When You visit the Website(s), a cookie banner will provide additional information and options to opt out of non-essential cookies where required by law.
10. NOTICE FOR CALIFORNIA RESIDENTS
10.1 This clause applies only to California residents and the Personal Information We collect as a Business under the CCPA/CPRA. Terms such as Business, Business Purpose, Consumer, Personal Information, Sale/Sell, Service Provider, Sensitive Personal Information, and Share have the meanings given in the CCPA/CPRA.
10.2 Categories of Personal Information collected in the prior twelve (12) months may include:
a) Identifiers (e.g., real name, alias, postal address, unique identifier, IP address, email address, account name, SSN, passport number);
b) Signature, physical characteristics/description, telephone number, state ID number, insurance policy number, employment/history, bank/credit/debit details, or other financial/medical/health insurance information;
c) Protected classification characteristics (e.g., gender, date of birth);
d) Internet/electronic network activity (e.g., browsing/search history, interaction with a website/app/advertisement);
e) Geolocation data;
f) Audio, electronic, visual, thermal, olfactory, or similar information.
10.3 Disclosure: We may disclose the above categories for a business purpose to service providers/contractors/third parties who support Our business, provided they (a) do not Sell/Share such Personal Information, (b) do not retain/use/disclose for any purpose other than performing services specified in Our contract, or (c) do not combine with other information received directly by them. We do not Sell/Share Personal Information without providing a right to opt out and have not Sold/Shared Personal Information in the prior 12 months. We do not Sell/Share Personal Information of minors without the required consent.
10.4 California rights include: request for categories/specific pieces collected; request for information Sold/Shared and to whom; correction; deletion; opt-out of Sale/Sharing; limit use of Sensitive Personal Information; portability; non-discrimination. Consumers may submit requests per Section 13 (include “California Privacy Rights Request” plus name and address). Authorized agents may be designated to exercise these rights.
11. PRIVACY OF CHILDREN
We do not knowingly request or collect Personal Data from children under 18. If a parent/guardian becomes aware a child has provided Personal Data, they should contact Us at the address in Section 13.
12. NOTICE TO CUSTOMER AND OTHER EXCLUSIONS
12.1 Other than the Personal Data collected for the purposes set forth in Section 2 (for which We act as Controller), for any processing of Personal Data collected from or transmitted by a Subscriber, We act only as a Processor, and such processing is governed by Our agreement with the Subscriber. Where the Services are made available to an End-User through a Subscriber, that enterprise is the Controller of the End-User’s Personal Data. End-Users should direct privacy requests to the Subscriber. We are not responsible for Subscribers’ privacy or security practices, which may differ from this Notice.
12.2 Our Website(s) may contain links to other websites. This Notice applies only to Our Website(s). When You click a link to another website, You should review its privacy notice.
